The Law and Illegally Tipping Asbestos

Once the link between asbestos and mesothelioma was proven the British government set about banning the use of it in building materials. This step should hopefully have prevented some people from developing mesothelioma. However, it is estimated that half of Britain's buildings still contain asbestos somewhere. This is no cause for concern because it is only if asbestos fibres are inhaled that they cause problems. However, if the asbestos is removed it needs to be tipped lawfully so that it does not become a health risk.

Illegally dumping asbestos - just like illegally dumping any other hazardous or toxic material - is known as fly-tipping, and there are tough penalties for anyone involved in this practice. Not only does the law punish the fly-tipper but also any land-owner who allows fly-tipping to take place, and any person who doesn't take reasonable steps to ensure they have hired someone who will lawfully get rid of the asbestos.

Of course, you can always get rid of asbestos yourself granted that you use the right equipment and dump it according to the law. These guidelines can be quite complex so make sure you follow them carefully. Details can easily be found online, and you can even find out where the nearest place that you can take your waste is located.

And if you dump asbestos illegally? You're looking at a fine of up to 50,000 in Magistrate's Courts. This fine is unlimited in higher courts. As well as financial penalties, offenders could face community punishment orders and even a custodial sentence of up to five years.

If you're aware of anyone that has illegally fly-tipped asbestos you should inform your local council - it could stop people becoming very ill in the future. It's unfortunate that such penalties are needed to stop people dumping a substance as deadly as asbestos, but because some people fail to recognise how serious mesothelioma is they need to be in place.
